1. Acceptance of Terms

By using any service provided by Swiftway Shipping, the customer agrees to be bound by these Terms and Conditions. The customer confirms that they have read, understood, and accepted these Terms in full. Continued use of our services constitutes ongoing acceptance.

2. Scope of Services

Swiftway Shipping provides courier and logistics services, including but not limited to:

  • International air and sea freight shipping

  • Assisted online shopping services

  • Warehousing and package handling

  • Mobile pickup and delivery services within Jamaica

  • Use of third-party carriers or delivery partners where applicable

Swiftway Shipping reserves the right to modify, suspend, or discontinue any service at its discretion without prior notice.

3. Shipping Schedule

Shipping schedules, including shipments departing approximately every three (3) days, are estimates only and are not guaranteed. Delays may occur due to customs processing, airline schedules, weather conditions, inspections, or other factors beyond our control.

4. Responsibility & Risk

All shipments are transported at the customer’s sole risk.

Swiftway Shipping’s responsibility begins only when a package is physically received at our U.S. warehouse and ends once the package is handed over to third-party carriers, customs authorities, or delivery partners.

Swiftway Shipping is not responsible for:

  • Packages delivered incorrectly or lost by vendors or carriers before reaching our warehouse

  • Loss, damage, or delays caused by third-party service providers

5. Packaging & Fragile Items

Swiftway Shipping handles packages with reasonable care; however, we are not responsible for damage caused by improper or insufficient packaging by vendors, senders, or customers.

Fragile items, electronics, liquids, glass items, or breakables are shipped strictly at the customer’s own risk, regardless of packaging method.

6. Prohibited & Restricted Items

Customers are solely responsible for ensuring all shipped items comply with local and international laws.

Prohibited items include, but are not limited to:

  • Illegal substances

  • Firearms, ammunition, or weapons

  • Explosives or hazardous materials

  • Counterfeit or restricted goods

Any prohibited item may be confiscated, disposed of, or surrendered to authorities without refund. All fines, penalties, or legal consequences remain the customer’s responsibility.

7. Customs, Duties & Fees

Customers are responsible for all customs duties, taxes, declaration fees, and related charges. Swiftway Shipping is not liable for delays, seizures, inspections, or penalties imposed by customs authorities.

8. Assisted Online Shopping Services

For assisted online shopping services:

  • Full payment must be deposited before any purchase is made

  • Customers must confirm item details prior to ordering

  • Swiftway Shipping is not responsible for vendor errors, delays, cancellations, out-of-stock items, or incorrect items ordered due to customer instructions

  • Refunds, exchanges, and disputes remain strictly between the customer and the vendor

9. Payments

All payments must be fully cleared before processing. Bank transfers must reflect as cleared funds prior to service commencement.

Once a shipment has commenced, all payments are final. No refunds or chargebacks will be accepted for delays or disruptions beyond our control.

10. Claims

Claims for missing or damaged items must be submitted within forty-eight (48) hours of notification of availability or receipt.

All claims must include:

  • Proof of value (invoice or receipt)

  • Clear photographic evidence

  • Written submission via official email or claim form

WhatsApp messages do not constitute official claims.

11. Insurance

Swiftway Shipping does not provide insurance coverage. Customers ship at their own risk and are encouraged to arrange private insurance if desired.

12. Storage & Uncollected Packages

Packages not collected within seven (7) days of notification will incur a storage fee of JMD $150 per day.

Packages uncollected after thirty (30) days may be auctioned, donated, or disposed of to recover storage and administrative costs. Customers remain responsible for all outstanding charges.

13. Cancellations

Cancellations must be requested at least twenty-four (24) hours prior to the scheduled service where applicable. Cancellation fees may apply. Swiftway Shipping reserves the right to cancel services at its discretion.

14. Amendments

Swiftway Shipping reserves the right to update or modify these Terms and Conditions at any time. Updates take effect immediately upon posting on our website or customer portal.

15. Entire Agreement

These Terms and Conditions constitute the entire agreement between Swiftway Shipping and the customer and supersede all prior agreements or understandings.
